Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Oddsrt™, having its registered office at Rasamrita Kunj, Gochhari, Gopalpur, Khagaria, Bihar - 851203, India (“we”, “us”). By accessing or using our website or services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a contract under Indian law to use our services.

2. Services

Oddsrt provides digital services including but not limited to:

• Web Design & Development (Business websites, e-commerce, custom web apps)
• Android App Development (Native and cross-platform mobile applications)
• Digital Marketing (Social media management, paid advertising, content marketing)
• SEO Optimization (On-page, technical, and off-page SEO strategies)
• Graphic Design (Brand identity, UI/UX assets, marketing creatives)
• Video Production & Editing (Promotional videos, ads, corporate storytelling)

Specific deliverables are governed by individual project agreements signed with the client.

3. Intellectual Property

Unless otherwise agreed, Oddsrt retains ownership of all underlying code, designs, and methodologies used to deliver services. Client deliverables (e.g., final website) are transferred to the client upon full payment.

4. Usage & Conduct

You agree not to misuse our services, including but not limited to attempting to hack, disrupt, or reverse-engineer our platforms.

5. Indemnification

You agree to indemnify, defend, and hold harmless Oddsrt, its founders, and employees from any claims, liabilities, damages, or expenses arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights (including intellectual property rights).

6. Force Majeure

Oddsrt shall not be liable for any delay or failure in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, internet outages, server failures, or government restrictions.

7. Limitation of Liability

To the fullest extent permitted by law, Oddsrt shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you for the specific service in dispute.

8. Governing Law

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Khagaria, Bihar, India.

9. Attribution, Branding & Use of Name

9.1 Attribution & Acknowledgment

Unless otherwise agreed in writing, any attribution or acknowledgment referencing Oddsrt as the developer, designer, or service provider shall be limited to a neutral vendor acknowledgment approved by Oddsrt (e.g., “Designed & Developed by Oddsrt”, “App Developed by Oddsrt”, “Digital Marketing by Oddsrt”, “SEO by Oddsrt”, etc.). Such attribution does not imply endorsement, sponsorship, partnership, or affiliation with the client’s views, activities, ideologies, or positions.

9.2 Control of Attribution

The form, wording, placement, visibility, or removal of any attribution or acknowledgment referencing Oddsrt shall remain at the sole discretion of Oddsrt, regardless of payment status, project scope, or duration of engagement.

9.3 No Implied Association

Attribution or acknowledgment of Oddsrt shall not be interpreted as support for, endorsement of, or affiliation with any political, religious, ideological, advocacy, or social agenda of the client. Oddsrt’s role is strictly limited to providing professional digital and creative services.

9.4 Use of Name, Logo & Branding

Oddsrt’s name, logo, trademarks, or branding elements may not be used in promotional materials, announcements, events, social media, donor communications, press releases, or campaigns without prior written approval from Oddsrt. Any permitted use shall be limited to a standard footer-style acknowledgment only.

9.5 Modification or Removal of Attribution

Oddsrt reserves the right to request the modification or removal of any public attribution or reference if the client’s activities, affiliations, or messaging create reputational, ideological, political, or legal risk for Oddsrt. The client agrees to comply with such requests within a reasonable timeframe.

9.6 Pro-Bono & Free Services

The provision of free or pro-bono services does not grant the client any additional rights to attribution, endorsement, or public association with Oddsrt beyond what is expressly permitted.

9.7 Portfolio & Case Study Usage

Oddsrt may choose, at its discretion, whether to publicly or privately reference a project for portfolio or case study purposes. The absence of public showcasing shall not be construed as dissatisfaction or breach of contract.

10. Survival

The provisions relating to attribution, use of name, neutrality, non-association, intellectual property, and limitation of liability shall survive the completion or termination of the engagement.
